Terms & Conditions
1. About these terms
These terms govern your use of the PolishPro app for iPhone, iPad and Android (the “App”), published by the developer of PolishPro, an individual developer based in Poland (“we”, “us”), contact coffee.dev.app@gmail.com. By downloading or using the App you accept these terms. They apply together with the terms of the store you got the App from:
- App Store: Apple’s Licensed Application End User License Agreement (“Apple EULA”). These terms supplement the Apple EULA; where they differ, the Apple EULA governs the licence itself and these terms cover everything specific to the App. Section 11 also applies.
- Google Play: the Google Play Terms of Service, which govern your use of Google Play itself. Section 12 also applies.
2. What the App is
The App helps you learn Polish and practise for the Polish state certificate exam (Państwowy egzamin certyfikatowy z języka polskiego jako obcego). It contains lessons, exercises, vocabulary tools and practice exams.
- Not official. The App is not affiliated with, endorsed by or connected to the State Commission for the Certification of Proficiency in Polish as a Foreign Language (Państwowa Komisja do spraw Poświadczania Znajomości Języka Polskiego jako Obcego) or any examination centre. Practice exams are for training only.
- No guarantee of results. Using the App does not guarantee that you will pass any exam or reach any level.
- AI scores are estimates. Writing and speaking answers are scored by an AI language model running on your device. Its scores, corrections and feedback may be inaccurate and are not an official assessment. Speech-to-text may mis-hear what you said.
3. Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on devices you own or control, as permitted by the rules of the store you got it from (for the App Store, the Apple EULA and the App Store’s Usage Rules, including Family Sharing where it is enabled). You may not copy, extract, resell or redistribute the App’s content (lessons, exercises, exams, audio, images), or reverse-engineer the App, except where the law expressly allows it.
4. Free and Premium content
Part of the App is free. Other topics, exams and features require a Premium plan. The current plans, their prices in your currency and what they include are shown in the App before you buy. Purchases are made through the App Store (charged to your Apple ID) or Google Play (charged to your Google account).
- Exam Pass (3 months) — a one-time payment that gives Premium access for 3 months from the purchase. It does not renew automatically. Buying another Exam Pass extends access by another 3 months from the end of the current one.
- Yearly — an auto-renewable subscription, with a 7-day free trial if you are eligible. Unless you cancel before the end of the trial or the current period (on the App Store, at least 24 hours before), it renews automatically and the store charges the yearly price for the next period. You can manage or cancel it from “Manage subscription” in the App, or in your store account: on iPhone / iPad in Settings › your name › Subscriptions; on Android in Google Play › your profile › Payments & subscriptions › Subscriptions. Cancelling stops the next renewal; access continues until the end of the paid period. If you buy a subscription during a free trial, the unused part of the trial ends.
- Lifetime — a one-time payment for permanent Premium access to the App (on the App Store, shareable with Family Sharing). “Lifetime” means for as long as we offer the App and its content.
The App has no user accounts, so a purchase belongs to the store account you made it with: a plan bought on the App Store works on your Apple devices, and a plan bought on Google Play works on your Android devices; one does not unlock the other. You can restore purchases on another device of the same platform with “Restore purchases”. Prices may change; a change never affects a period you have already paid for, and the store will notify you of a price change for a subscription as required.
5. Refunds and your consumer rights
Payments, billing and refunds are handled by the store you bought from:
- App Store: under Apple’s Media Services Terms and Conditions. To request a refund, go to reportaproblem.apple.com.
- Google Play: under the Google Play refund policies. You can request a refund in Google Play, or write to us.
Nothing in these terms limits the rights you have as a consumer under the law of your country of residence, including any statutory right of withdrawal or rights concerning digital content that does not conform to the contract.
6. Your content
Your answers, texts, recordings and the words you add stay yours. They are stored on your device, as described in our Privacy Policy. We do not receive them and claim no rights in them.
7. Downloads and third-party content
The App downloads its lessons and exams on first launch and their updates later, and lesson media when you first open it. The on-device AI model (about 2.9 GB) is downloaded over Wi-Fi only, after you agree. Some lessons embed YouTube videos. Third-party services are subject to their own terms, and the AI model is provided under its own licence. We are not responsible for the availability of third-party services. The App’s lessons, exercises and exams are protected by the copyright of the developer and/or third parties.
8. Availability and changes
We may update the App, add, change or remove content and features, for example to fix errors or improve the course. We will not remove the core of what you paid for during a paid period without good reason, such as a legal requirement. The App may occasionally be unavailable or contain errors; please report them to us.
9. Requirements and complaints
The App needs an iPhone or iPad with iOS / iPadOS 17 or later, or an Android device with Android 8.0 or later, and an internet connection on first launch to download the lessons. AI scoring needs about 3 GB of free storage for the model and a Wi-Fi connection for its one-time download, and may not be available on devices with too little memory. If something in the App does not work as described, write to coffee.dev.app@gmail.com with a short description of the problem. We will reply within 14 days. Complaints about payments are handled by the store you bought from (see section 5).
10. Liability
The App is provided for learning purposes. To the extent permitted by law, we are not liable for indirect or consequential loss, or for decisions you make based on practice scores (such as registering for an exam). Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including liability for wilful misconduct or gross negligence, or your statutory rights as a consumer.
11. Apple (App Store downloads)
If you got the App from the App Store: these terms are between you and us, not Apple. Apple is not responsible for the App or its content, and has no obligation to provide maintenance or support for it. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation regarding the App. We, not Apple, are responsible for handling any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, consumer-protection claims and claims that the App infringes third-party intellectual property rights. You confirm that you are not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
12. Google (Google Play downloads)
If you got the App from Google Play: these terms are between you and us, not Google. Google is not responsible for the App or its content. Your use of Google Play, including payments, is governed by the Google Play Terms of Service.
13. Ending use
You can stop using the App at any time by deleting it. Deleting the App does not cancel a Yearly subscription — cancel it in your App Store or Google Play account (section 4). We may end your licence if you seriously breach these terms.
14. Changes to these terms
We may update these terms, for example when the App or the law changes. We will change the effective date above and announce material changes in the App’s release notes. Changes do not apply retroactively to periods already paid for.
15. Law and disputes
These terms are governed by Polish law. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, and you may bring a claim before the courts of that country. Please contact us first — most problems can be solved by e-mail.
If any provision of these terms is found invalid or unenforceable, the remaining provisions stay in effect. If we do not enforce a right under these terms, we do not waive it.
